Attorney Rodney E. McPhee Wins Supreme Court Decision
Rodney E. McPhee, Chair of the Firm's Litigation Practice Group, has been representing Hale Mountain Fish and Game Club for many years in numerous lawsuits and appeals filed by neighbors who have been trying to shut down the 60+-year-old club situated on Rod and Gun Club Road in Shaftsbury, Vermont. The Club has operated a traditional Vermont sportsperson's club on the same property since approximately 1949. In 2004, neighbors began an intentional, sustained, and systematic effort to shut the Club down by bringing what one Superior Court Judge called a "fusillade" of sometimes redundant and vexatious pieces of litigation, administrative proceedings, and other legal actions against the Club and its members, officers, and attorneys. The decision by the Vermont Supreme Court is the latest victory by Facey Goss & McPhee P.C., in defending the Club against neighbors who are opposed to the Club's shooting activities. Based on the recent decision, the Firm anticipates that all necessary permits will finally be issued to the Club and it will continue to operate for many years to come.
